HARRISBURG – Legislation will be proposed by Sen. Lisa Boscola of Lehigh & Northampton Counties which would prohibit the publication of AI-generated deepfakes targeting candidates for public office before an election. Her proposal will prohibit AI-generated or AI-altered video, audio, or images depicting a candidate for public office during the 90 days before an election, where the publisher intends to harm the candidate’s reputation or deceive voters about a candidate’s conduct or positions. Deepfakes threaten candidates regardless of party affiliation and undermine the ability of every PA voter to make an informed choice. Twenty-nine states have enacted laws addressing AI deepfakes in elections, including New York, New Jersey, Delaware, and Maryland. A co-sponsorship memo seeking support of the measure is being circulated.
