LANCASTER Area workers for Penn Medicine, who were dismissed from their jobs for not getting a COVID-19 vaccine have filed a federal lawsuit. The lawsuit, filed in U.S. District Court, alleges constitutional violations because of the COVID-19 vaccine mandate. The suit lists defendants as the Penn Medicine health system, the United States Department of Labor and the US Health and Human Services Department. The civil suit alleges that the health system deprived workers of their First and 14th Amendment rights and is seeking damages for the following counts: The compulsion of political speech,Violation of free exercise of the First Amendment, and Violation of part of the 14th Amendment, which is the amendment that gave citizenship to former slaves but also includes the “right to privacy and body.” The suit also alleges wrongful dismissal in violation of Pennsylvania public policy. Hundreds of employees have left Penn Medicine Lancaster General Health since the system’s vaccine mandate was announced last spring.
